Jussie Smollett’s hate crime conviction has been overturned.
The Illinois State Supreme Court has dismissed Jussie Smollett’s conviction for lying about an alleged hate crime in Streeterville, citing a due process violation. In a 5-0 decision issued Thursday, the court ruled Smollett should not have stood trial after prosecutors struck a deal to drop charges in exchange for a fine and community service. The court emphasized that agreements made by prosecutors must be upheld, stating, “What would be more unjust than resolving any one criminal case unfairly would be holding that the State is not bound to honor agreements upon which people have detrimentally relied.” Smollett was charged in 2019 with felony disorderly conduct for allegedly staging a hate crime with the Osundairo brothers. Cook County State’s Attorney Kim Foxx’s office later dropped the charges, believing the resolution was appropriate. Smollett’s attorney called the case a “travesty” and praised the ruling.
